I tend to listen to instrumental music, a lot of which I find uplifting and inspirational.
Some of it includes some choral voices in the background, which I enjoy as well.

Husband – I did not know it was illegal to avoid the census. You don’t have to let them into your home, and you can avoid some answers, but you cannot NOT be “censused”, as he put it.

Court rules chalking tires for parking enforcement is unconstitutional
A federal appeals court ruled Monday that it is unconstitutional for a parking enforcement officer to chalk drivers’ tires to keep track of how long a vehicle has been parked.
A three-judge panel of the 6th U.S. Circuit Court of Appeals in Cincinnati made the decision by reinstating a 2017 case from a woman who had been issued 15 parking tickets in three years in Saginaw, Mich., according to NBC News.
The woman, Alison Taylor, said in a lawsuit that she had been issued all of the tickets by the same officer, described as the city’s “most prolific issuer of parking tickets,” in that timeframe.
Taylor claimed in the lawsuit that marking a car’s tires with chalk should be classified as an unreasonable search under the Fourth Amendment. A U.S. district judge in Michigan dismissed the suit in 2017, saying that chalking a tire constituted a reasonable search because the procedure wouldn’t violate Taylor’s privacy.
Two of three members of the appeals court’s panel disagreed on that detail, ruling that chalking a tire was unreasonable search, NBC News reported.
“The city commences its search on vehicles that are parked legally, without probable cause or even so much as ‘individualized suspicion of wrongdoing’ — the touchstone of the reasonableness standard,” U.S. Circuit Judge Bernice Bouie Donald wrote.
The judge also said the city was wrong to argue that parking enforcement is part of its “community care taking” responsibility since overstaying a parking spot doesn’t cause harm to the community. Today is the SCOTUS hearing on the census citizenship issue. Thought Treepers might be interested in the likely outcome (PDJT wins) and legally why.
Background: the census is mandated by A1§2.3 and is used to apportion the House seats among the states based on total population. Starting in 1970 there were two forms used, short (~90%) and long (~10%). Before 1970, the citizenship question was frequently on the single form; it was retained on the long form ever since 1970.
The issue: three judges have held adding the citizenship question to the 2020 short form is unlawful. One reasoned that Sec. Commerce did not follow the Administrative Procedures Act (APA). Two held that the question itself is unconstitutional (but not on long form???).
APA (1946) defines the rule making process federal agencies must follow in making regulatory and licensing decisions. It is intended to provide openness and public input. The key provision for this census issue is the first, 5USC§551 definitions. §551(a)(1) defines ‘agencies’ to include Census Bureau. (a)(4) defines ‘rules’ as “designed to implement, interpret, or prescribe law or policy”.
There are three simple reasons APA does not apply:
1. The census question is by definition not a rule.
2. The governing Census Act of 1976 (CA76) was passed thirty years later so supersedes EVEN if the question were a ‘rule’ (traditional congressional intent construction).
3. CA76 13USC§141(a) provides in part “The Secretary shall in the year 1980 and every 10 years thereafter take a decennial census…IN SUCH FORM AND CONTENT AS HE MAY DETERMINE”, subject to an (f)(2) proviso that he provide congress two years prior to the census a report containing his determinations of questions proposed. Ross did so, hence the kerfuffle. The delegation by Congress to Ross is absolute and unqualified.
Unconstitutional per se
A1§2.3 commands the decennial census “IN SUCH MANNER AS THEY (the affected by apportionment House) SHALL BY LAW DIRECT.” Specifically, by 13Uc§141. Yet two federal judges have ruled otherwise.
A clearer case of legal TDS and lawfare does not exist. IMO SCOTUS will find it easy to rule in favor of PDJT. Should be unanimous, but unfortunately it probably won’t be.

After reading through a lot of personal government service histories, the one I think who was the real henchman was Brennan. I doubt there will be too much pushback on that thought. However, on three others – Mueller, Comey, and Rosenstein – I will.

The 17th letter has dropped out-of-site now that it’s psy-op is over. Now whether that psy-op was for good or bad will be argued for a few years and then forgotten. But a lot of people made a lot of money off of it. Not one of them got a dime from me.
